1. Introduction

Mikaël Buxton, a business registered in France under SIREN 484 811 443 (hereinafter “the Company”), sells online educational content and training programs through the website https://automa-course.com/ (“the Website”).
Any purchase of a training program implies full acceptance of these Terms and Conditions of Sale (“T&Cs”) by the customer (“the Client”).

2. Purpose and Scope

These T&Cs define the conditions of sale, access, and use of the training programs and educational content provided on the Website.
They apply to all orders placed on the Website by individuals or businesses.
The applicable version is the one published on the Website at the time the order is confirmed.

3. Training Offer

The Company provides online training content, particularly related to the Automa browser extension, including video modules, tutorials, documents, and other educational materials.
Each training program page details the essential characteristics: content, scope, prerequisites, access conditions, availability period, and pricing.

4. Registration and Agreement

4.1. The Client selects the desired training, completes the registration form, accepts the present T&Cs, and proceeds with payment.
4.2. Payment validates the order and constitutes acceptance of the T&Cs.
4.3. The Company sends confirmation to the email address provided by the Client.
4.4. Access to the training is granted once full payment has been received.
4.5. The Client is responsible for having suitable equipment (computer, browser, internet connection).

5. Pricing and Payment Terms

5.1. Prices are listed in euros (€).
5.2. Payments can be made by credit card or PayPal.
5.3. When instalment payments are offered, the applicable terms are displayed during checkout.
5.4. In the event of late payment, access to the training may be suspended.
5.5. Discounts or promotional offers apply only under the conditions specified on the training page.

6. Withdrawal, Cancellation, and Refund Policy

6.1. In accordance with EU consumer law (Directive 2011/83/EU), individual consumers may benefit from a 14-day withdrawal period for distance purchases, unless an exception applies.
6.2. If access to the training begins immediately and the service is considered fully delivered before the end of the withdrawal period, the right of withdrawal may not apply.
6.3. Cancellation or postponement conditions (whether requested by the Client or the Company) are set out on the training page.
6.4. Progress-based Refund Limitation:
When immediate access is granted, the Client acknowledges that viewing the modules constitutes the start of service delivery.
Once more than 10% of the total training content has been viewed, accessed, or downloaded, no refund is possible, even within the legal withdrawal period.
Progress is tracked by the platform’s internal monitoring system.
Exceeding the 10% threshold makes the sale final.

7. Access Rights and Intellectual Property

7.1. The Company grants access to the training content for the duration specified on the training page.
7.2. The Client receives a strictly personal, non-transferable, limited licence to view the materials.
7.3. All content (videos, texts, documents, graphics, logos) is protected by intellectual property laws. Any reproduction, distribution, or modification without prior written consent is prohibited.
7.4. Commercial use of the materials is not permitted unless expressly authorised in writing.

8. Client Obligations

8.1. The Client guarantees the accuracy of information provided during registration.
8.2. The Client agrees to use the training content in accordance with the T&Cs.
8.3. In cases of abuse, attempted sharing of access, or breach of these T&Cs, the Company may suspend or terminate access without refund.

9. Liability and Limitations

9.1. The Company undertakes reasonable efforts to provide the content as described but does not guarantee specific results.
9.2. The Company’s liability is limited to the amount paid for the relevant training.
9.3. The Company is not responsible for technical issues related to the Client’s hardware, software, browser, or internet access.

10. Personal Data Protection

Personal data collected during registration or access to the training is handled in accordance with GDPR and applicable French data protection laws.
The Client may consult the privacy policy available on the Website.

11. Force Majeure

The Company cannot be held liable for any failure to perform due to circumstances defined legally or judicially as force majeure.

12. Modification of These T&Cs

The Company may update these T&Cs at any time.
The version applicable to the Client is the one published on the Website at the moment of purchase.

13. Governing Law and Jurisdiction

These T&Cs are governed by French law.
Any dispute shall fall under the exclusive jurisdiction of the courts of the Company’s registered office, unless otherwise required by law.
